One thing to be clear about is that the main objective is to protect the best interests of the child. Children have the right to have an equal relationship with both parents whenever possible.
But joint custody is not applicable to all cases, as it depends on the circumstances of the parents and on the fulfillment of a series of requirements.
The Civil Code of Catalonia regarding custody and guardianship establishes the following criteria to be taken into account in order to opt for joint custody:
- Bonding between children and parents
- The ability of parents to ensure the welfare of their children
- The attitude of each parent to cooperate with the other parent.
- The amount of time each parent has devoted to the care of the children prior to the breakup.
- The opinion of the children
Agreements adopted outside the agreement prior to the commencement of the breakup process - The location of both parents’ addresses
- Schedules and activities of both parents and children
