Execution of the regulatory agreement
In the event that one of the spouses fails to comply with any of the elements of the judicially approved regulatory agreement, the other spouse may demand its compliance by means of an enforcement action.
Modification of the regulatory agreement
The measures agreed in the regulatory agreement may be modified as many times as necessary, as long as the needs of the children or the change of circumstances of the spouses justify it.
Case law establishes that the regulatory agreement may be modified when:
- There has been a change or alteration of circumstances subsequent to the approval or prior to it but unknown to the person requesting the modification.
- The change or alteration is substantial and permanent.
- Such change or alteration is unforeseen and beyond the control of the person requesting the modification.
- The above aspects can be proven by the spouse requesting the modification.
This modification may be carried out either by mutual agreement of the spouses, or contentiously in the event that one of the spouses opposes such modification.
