Today we share a new media appearance, this time an interview for ‘El País Smoda’ in which we talk, along with other legal professionals, about a curious concept that is present in our daily work as family lawyers: financial infidelity. There are several studies that confirm that, among couples who share their finances, it is common to hide expenses between them.
The figures of studies focused on the United States are between 30 and 40 percent of those surveyed, on average, which speaks of a very normalized practice.
What about Spain?
The truth is that it is not a concept that we use too much, which does not mean that it is not a frequent practice.
In fact, it can be grounds for divorce when one of the parties discovers this type of ‘infidelity’.
After all, the logic is similar: the concealment of relevant information from the partner.
Our practice at Crespo Law teaches us that, given that in Catalonia the economic regime of separation of property is the one established by default upon marriage, deceit is less frequent because the economy is not shared.
There is usually a common account for the common expenses, and each one keeps his or her own private accounts.
Of course, there is often “silence about money”, as I explain in the article. It is not uncommon to not know how much the other spouse earns, no matter how many decades they have been living together as a married couple.
In addition, another key idea is that, in the case of the wife, her economy is more protected by the community property regime (where everything is divided 50/50 in case of divorce), as long as the usual tendency is that she is the one who reduces her working hours or gives up all or part of her professional career to take care of the family.
In the case of our firm, we see this in 90 percent of our clients. If you want to read the complete article, you can do it in this link, pleasecontact our team of family lawyers in Barcelona if you need advice or have any doubts.
